Terms of Service & Marketplace Policy
Updated October 8, 2026
Our role
Sold Toys is an advertising and listing business. We are not a broker, dealer, sales agent, consignment service, or transaction intermediary. We do not represent buyers or sellers as their broker or sales agent. Our services include publishing and promoting seller advertisements, automated saved-search matches and alerts, and forwarding marketplace inquiries. Sold Toys does not own the listed item, negotiate prices or purchase terms, accept offers or enter into purchase agreements for either party, inspect the item, transfer title, arrange financing, or receive, hold, or transfer the purchase price or a purchase deposit. Fees paid to Sold Toys are for advertising, listing, and related platform services and are not commissions based on an item's sale price. Buyers and sellers enter into their purchase agreement directly and arrange the purchase payment, inspections, required disclosures, taxes, and ownership transfer. Nothing in these terms limits rights or duties that applicable law does not allow to be waived.
Seller responsibilities
Listings must be submitted directly by the private legal owner of the toy. Dealer, third-party broker, sales-agent, and consignment listings are not accepted. We do not work with third-party brokers, sales agents, or consignment intermediaries acting between an owner and buyer, and we do not accept listings submitted in those capacities. Sellers must confirm that they personally own the toy and are listing it directly. Sellers are responsible for any license or registration required for their activity and for all required sale documents and disclosures. A private-owner account may not be used to conceal commercial sales activity.
Accurate ownership and condition information
Sellers must provide accurate information about ownership, title or registration status, liens, mileage or operating hours, condition, known material defects, damage, modifications, and included equipment. Applicable salvage, rebuilt, flood, or other title brands must be disclosed. If a title is unavailable or the item is exempt from titling, the seller must state that clearly and identify the available ownership documents. Sellers must have permission to publish submitted photos, videos, and contact information, and must promptly update a listing when an item is sold, unavailable, or materially changed.
Listing review and matching
Review or approval for publication is not a certification of ownership, title, lien status, condition, safety, value, seller licensing, or suitability. Matches and alerts use the information supplied by buyers and sellers. They do not guarantee availability, legal eligibility, a qualified buyer, a sale, a sale price, a sale date, or any minimum number of inquiries. Buyers should confirm all information directly with the seller.
Buyer verification and state requirements
Before paying for or accepting an item, buyers should independently verify the seller's authority, the item's identity, ownership documents, title brands, liens and any required lien release, condition, and applicable registration eligibility. Buyers should arrange an appropriate independent inspection and obtain written purchase terms. Boats, outboard motors, trailers, RVs, motorcycles, and off-highway vehicles may require separate documents. A title, registration, or street-legal claim from one state does not establish eligibility in another state. Buyers and sellers are responsible for the applicable federal, state, local, and other jurisdictional sale, tax, insurance, inspection, emissions, registration, and operating requirements.
Purchase payments and delivery
Sold Toys does not provide escrow or guarantee a buyer or seller payment, possession, delivery, or title transfer. The parties arrange and verify their own purchase payment, any lender payoff, transportation, and delivery. A Sold Toys listing-payment receipt or listing ID is not proof that the item has been purchased or that purchase funds are protected.
State rights and seller warranties
Warranty obligations, required disclosures, cancellation rights, and remedies depend on the seller, item, and applicable law. Nothing in this policy, a listing, or an as-is statement removes rights or obligations that applicable law does not allow the parties to waive. Buyers should obtain any seller warranty or return agreement in writing.
Listings and approval
Payment does not guarantee publication. Sold Toys may review, reject, place on hold, archive, or remove listings that appear inaccurate, fraudulent, unsafe, unlawful, misleading, duplicated, or inconsistent with the service.
Listing service charges
The selected package price, included services, listing period, applicable taxes, and refund terms must be disclosed before payment. A payment for Sold Toys services is separate from the price of the listed item. See our Listing and Refund Policy for cancellation and billing questions.
Your content and permission to publish
You keep ownership of your photos, videos, and listing text. By submitting them, you give Gesture LLC, doing business as Sold Toys, a nonexclusive, royalty-free permission to host, copy, display, format, and publish them to provide your selected listing package. For packages that include social promotion, this includes posting your listing content on our social channels and using service providers to deliver those services. You confirm you have the necessary rights and permissions. Editing and photo enhancement must not conceal damage, change condition, or add equipment. Tell us if an edit changes an important fact. You may request removal of a listing or promotional post we control; we cannot recall third-party copies or shares. We may retain records reasonably needed for support, legal obligations, and disputes.
Service expectations and responsibility
We work to keep Sold Toys useful and reliable, but cannot promise uninterrupted service, error-free listings, a particular buyer match, or a sale. To the extent allowed by law, our total liability arising from use of the platform is limited to the greater of $100 or the fees you paid Sold Toys in the 12 months before the event giving rise to the claim. To the extent allowed by law, we are not responsible for indirect or consequential losses, including lost profits. These limits do not apply to our fraud, intentional misconduct, gross negligence, or rights and liabilities that cannot legally be limited.
Claims involving seller content
If a third party brings a claim because your submitted content infringes their rights or because you knowingly provided false listing information, you are responsible, to the extent allowed by law, for the resulting reasonable defense costs and damages attributable to that conduct. This does not make you responsible for Sold Toys’ own negligence or misconduct. We will promptly notify you, allow reasonable participation in the defense, and seek your consent before a settlement that imposes obligations on you; consent must not be unreasonably withheld.
Working through concerns
Please contact info@soldtoys.com so we have a reasonable opportunity to help resolve a concern. This does not prevent you from using small claims court, contacting regulators, exercising payment-dispute rights, or meeting a legal deadline. Arizona law governs these terms where permitted, without overriding mandatory protections that apply to you. Where legally permitted, disputes may be brought in courts serving Yavapai County, Arizona.
